1) SCOPE OF APPLICATION

1.1 These General Terms and Conditions (“GTC”) of Morvesa (“Seller”) apply to all contracts concluded between a consumer or business (“Client”) and the Seller concerning products presented in the online store. Any terms of the Client shall not apply unless expressly agreed in writing.

1.2 A “consumer” is any natural person acting for purposes outside their trade, business, or profession.

1.3 A “professional” is any natural or legal person acting within their commercial or professional activity.

2) CONCLUSION OF CONTRACT

2.1 Product descriptions on the website do not constitute binding offers but an invitation to place an order.

2.2 The Client may submit a binding offer by completing the ordering process in the online store.

2.3 The contract is concluded when Morvesa accepts the order via email confirmation or shipment of the goods.

2.4 Orders are automatically confirmed by email. The Client must ensure that the provided email address is correct and accessible.

2.5 The contract text is stored and can be requested by email.

3) RIGHT OF WITHDRAWAL

3.1 Consumers have the right to withdraw from the contract within 14 days without giving any reason.

4) PRICES AND PAYMENT TERMS

4.1 All prices shown are final prices and include applicable taxes. Shipping costs, if applicable, are clearly displayed during checkout.

5) DELIVERY AND SHIPPING CONDITIONS

5.1 Delivery is made to the address provided by the Client.

5.2 Orders are processed within 1–3 business days and delivered on average within 6–12 business days, depending on the destination.

5.3 If delivery cannot be completed due to reasons attributable to the Client (incorrect address, absence, etc.), any additional costs may be charged to the Client.

5.4 If a product is unavailable, the Client will be informed immediately and fully refunded.

6) RETENTION OF TITLE

The goods remain the property of Morvesa until full payment of the purchase price has been received.

7) LIABILITY FOR DEFECTS (WARRANTY)

7.1 Legal warranty rights apply to consumers.

7.2 In case of defects, the Client may request repair, replacement, or refund in accordance with applicable law.

7.3 Professionals must inspect goods and report defects within a reasonable period.

8) LIABILITY

8.1 Morvesa is fully liable for damages caused by intentional misconduct or gross negligence, as well as for harm to life, body, or health.

8.2 In case of slight negligence, liability is limited to foreseeable damages typical for this type of contract.

8.3 Any further liability is excluded.

9) APPLICABLE LAW

Italian law applies. For consumers, mandatory consumer protection laws of the country of residence remain applicable.

10.2 Morvesa is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
